Waypointer Privacy Notice
Your privacy is important to us at Waypointer Ventures. This privacy notice describes the types of personal information we may collect or receive, how we process it, and why.
Waypointer offers mobile apps, cloud-based services via a web portal, and related products and services for use by (1) individual end users who use a Waypointer mobile app to engage in in-person experiences offered through the app and who interact with Waypointer and the experience’s organizers and points of interest (“End Users”), (2) businesses or other points of interest (e.g., a physical business location open to the public or a tourist attraction) that participate in Waypointer’s network by signing up for a Waypointer-enabled program to be a destination where End Users may check in with a Waypointer app (“Merchants”), and (3) organizations and entities that enter into agreements with Waypointer to offer experiences in which End Users can use a Waypointer app to check in at Merchants’ locations and earn points, rewards, or prizes (“Experience Providers”).
Please refer below to the portion of this privacy notice that applies to you based on whether you are an End User, a Merchant, or an Experience Provider. Also, please note the following with respect to all Waypointer products and services:
- Waypointer is committed to the protection and security of the information it receives from or about you. Waypointer takes reasonable precautions to protect that information from unauthorized access and disclosure. But no precautions can guarantee security and effectiveness, so we cannot absolutely guarantee the safety and security of your information. We will do whatever is reasonable to prevent attacks or fraudulent activity, and we reserve the right to take measures we believe in good faith to be appropriate if something like this happens, including notifications to authorities and cooperation with them.
- Waypointer is located in the United States, and all data and information collected or received in its services are stored and processed in the United States. If you do not want your information transferred to, or processed and stored in, the United States, you should not use our services.
- Waypointer apps and services are not intended for children, and we will not knowingly collect any information from or about children under the age of 13. If we learn that we have inadvertently collected personal information from a child, we will take appropriate steps to delete that information in compliance with the Children’s Online Privacy Protection Act (COPPA) and other applicable laws.
- Any information that we collect, receive, or process for you is subject to this privacy notice that is in effect at the time of such collection, receipt, or processing. However, we may change this privacy notice from time to time. If we make any material changes to this privacy notice, we will notify you by posting the new version on our website and, if we can, by notifying you through our services or other contact information you have provided to us. We encourage you to check this privacy notice periodically for any such updates. Your continued use of Waypointer products or services constitutes your acceptance of any new version of this privacy notice.

- End Users
As an End User, you can use a Waypointer app and/or the Waypointer portal to interact with (a) Experience Providers (including to participate in their events or trails, to participate in any contests they offer for which you are eligible, and to receive offers and other marketing communications from them); (b) Merchants (including to check in at their physical locations using a Waypointer app, to make purchases from them, and to receive offers and marketing communications from them), (c) other End Users (including to send and receive messages and notifications to and from them), and (d) Waypointer (including for purposes of support and any interactions that happen through the Waypointer portal or Waypointer app). The data we collect from your or about you depends on the context of your interactions and the choices you make about the services you want to receive through Waypointer. We use that information to help us provide services to you, to personalize your experiences and services, to improve our products and services, and to provide advertising and marketing messages to you that we think are relevant to you (which may include communications relating to the events in which you participate, relevant offers from the Merchants and Experience Providers in our network, and targeted advertising that we think will be relevant to you).
What information do we collect from and about End Users and why?
- When you download a Waypointer app, you must provide some information about yourself to enable us to provide services that are relevant to you. This may include your name, email, and zip code.
- When you use our services, we may collect information about how you interact with our services, such as information about your device, the web browser or app you are using, your IP address, your time zone or specific device location, some of the cookies that are installed on your device, and the pages or services that you access during your use of our services. We may collect information like this using the following tools:
- Cookies: small data files placed on your device or computer, which often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
- Log files: files in our services that keep track of actions in our services, such as your IP address, browser type, internet or mobile service provider, referring/exit pages, and date/time stamps.
- Web beacons, tags, and pixels: electronic files used to record information about how you browse or navigate our services.
Note that our service does not respond to “do not track” signals from your browser.
- If you create an account through a Waypointer app or portal, you must create login credentials (such as an email address or username and a password) or, if available, use your login credentials from an available third-party service. You may also provide a public screen name and profile image.
- To participate in events or contests offered by Experience Providers and/or to use a Waypointer app to check in at a Merchant location, to make purchases from a Merchant, or to enroll in a premium membership, you must provide some additional information to us to enable us to provide those services, including to determine your eligibility for contests or promotions, screen for and prevent fraud, fulfill your orders, administer contests or other events, and award any points, rewards, or prizes. This may include information such as your mailing address, billing address, phone number, credit card information, date of birth, location, and the event(s) that you want to participate in.
- In addition, when you use the Waypointer app or services, we collect certain information that helps us provide the requested services to you and to personalize them for you. This may include additional information about your device, the location and time that you use the Waypointer app or other Waypointer service, the location and time that you check in at a Merchant location, the points or rewards associated with your account, and any information, messages, images, or other communications you send through the Waypointer app or services to Waypointer, to other End Users, to Merchants, or to Experience Providers.
- We may sometimes request feedback from you about your experiences using our products and services and interacting with Merchants and Experience Providers. We collect information like this as part of our efforts to maintain and improve high levels of customer service.
- We also collect information about the performance of our products, services, and systems. This information helps us to run, improve, and protect our products and services. Information like this entails collecting information about your usage, as well as others’ usage, of Waypointer products and services, and aggregating it so that we can study and use it for our legitimate purposes.
How and why do we share this information?
- We share information from and about you with our service providers to the extent they need it to help us to provide our products and services. For example, we have service providers to provide hosting services, online applications, payment processing, order fulfillment, forms to submit information to us, and email and SMS services to send messages to you and others. When you submit credit card information for a transaction, we pass that information to a third-party payment processor but do not store it or use it otherwise.
- When you participate in an Experience Provider’s experience or trail, the information you provide in your account with us and the information about your participation in that experience or trail is generally available to that Experience Provider, but we do not share that information with the Merchants.
- If you submit information that is intended to be publicly available (for instance, your screen name or profile image), that information may be viewed by anyone through the Waypointer services. And if you submit information that you request to be shared with others (e.g., messages, location information, transaction information, etc. that you send to another End User or submit to a Merchant or Experience Provider), we will share it with those requested third parties.
- If you submit feedback to us about Merchants or Experience Providers, we may share that feedback with them, but only if you have provided your consent to do so.
- If you use a third-party service to log in to our service, we must submit those login credentials to the third party, and we receive an authentication token (e.g., OAuth). But we do not store or use the third-party login credentials themselves.
- The Waypointer services include the ability for Waypointer, Merchants, and Experience Providers to send you offers, targeted advertisements, and other marketing communications that we believe may be of interest to you based on the information we have about you. We or the Merchant or Experience Provider may use the Waypointer portal to identify criteria for the audience of such a targeted communication, and the Waypointer service will send messages to the identified audience. For instance, a Merchant may wish to send an offer to past customers or to people who have expressed interest in similar businesses, or an Experience Provider may wish to send an invitation to its new experience to the End Users who participated in a similar experience in the past. When our service sends targeted marketing communications like this, the Merchant or Experience Provider will not receive your personal data, but we may use that data on their behalf to send you their marketing communication. - We may share your information to the extent necessary and appropriate when we believe in good faith that we are required to do so: (a) by law or to respond to a legal process, such as a court order, warrant, or subpoena; (b) to protect our other customers; (c) to maintain the integrity and security of our products and services; and (d) to protect lives or to protect the rights and property of Waypointer and its customers.
- If Waypointer is involved in a merger, acquisition, reorganization, sale of all or substantially all of its assets, financing due diligence, or bankruptcy proceeding, we may need to share your information with counterparties, lawyers, accountants, and other professional advisers assisting with such a transaction or proceeding.
How do you access and modify the personal information in your account?
In your Waypointer account, you will have access to much of your personal information, and you may modify or delete certain information by logging into your account via the Waypointer app or platform. If you wish to make any other modifications, additions, or deletions to the personal information we have, you may contact us at privacy@waypointer.com.
- Merchants
As a Merchant, you can use a Waypointer app and/or the Waypointer portal to interact with (a) Experience Providers (including to participate in their events or trails and to receive offers and other marketing communications from them); (b) End Users (including to permit them check in at your physical locations using a Waypointer app, to permit them to make purchases from you, and to send offers and marketing communications to them), and (c) Waypointer (including for purposes of support and any interactions that happen through the Waypointer portal or Waypointer app). The data we collect from your or about you depends on the context of your interactions and the choices you make about the services you want to provide or receive through Waypointer. We use that information to help us provide services to you, to facilitate transactions, to personalize your experiences and services, and to improve our products and services.
What information do we collect from and about Merchants and why?
- When you sign up with Waypointer to join our network of Merchants, you must provide us with certain information to allow us to identify you and provide services to you. This may include information such as the name of your business (entity name and trade name, as applicable), the physical address or location of your business, your business’ logo or other trademark(s), the name and contact information (email, phone number, and address) of one or more contact people who have the authority to interact with Waypointer for purposes of the Waypointer services, login credentials for your business’ Waypointer account (such as a username and password), and the event(s) that you wish to participate in as a Merchant.
- When you use our services, we may collect information about how you interact with those services, such as information about your device, the web browser or app you are using, your IP address, your time zone or specific device location, some of the cookies that are installed on your device, and the pages or services that you access during your use of our services. We may collect information like this using the following tools:

- We may sometimes request feedback from you about your experiences using our products and services and interacting with End Users and Experience Providers. We collect information like this as part of our efforts to maintain and improve high levels of customer service.
- We also collect information about the performance of our products, services, and systems. This information helps us to run, improve, and protect our products and services. Information like this entails collecting information about your usage, as well as others’ usage, of Waypointer products and services, and aggregating it so that we can study and use it for our legitimate purposes.
How and why do we share this information?

And if you submit information that you request to be shared with others (e.g., messages, location information, transaction information, etc. that you send to an End User or submit to an Experience Provider), we will share it with those requested third parties.
- If you submit feedback to us about Experience Providers, events, or End User interactions, we may share that feedback with them, but only if you have provided your consent to do so.
- The Waypointer services include the ability for you as a Merchant to send offers, targeted advertisements, and other marketing communications to End Users based on criteria you select. You may use the Waypointer portal to identify criteria for the audience of such a targeted communication, and the Waypointer service will send messages to the identified audience. When our service sends targeted marketing communications like this on your behalf, you will not receive the personal data of the End Users who receive the messages except to the extent that End Users respond directly to you and provide their information outside of the Waypointer services. As an Experience Provider, you can use a Waypointer app and/or the Waypointer portal to interact with (a) Merchants (including to invite them to participate in your events or trails, to monitor their participation in your events or trails, and to provide offers and other marketing communications to them); (b) End Users (including to invite them to participate in your events or trails, to monitor their participation in your events or trails, and to send offers and marketing communications to them), and (c) Waypointer (including for purposes of support and any interactions that happen through the Waypointer portal or Waypointer app). The data we collect from your or about you depends on the context of your interactions and the choices you make about the services you want to provide or receive through Waypointer. We use that information to help us provide services to you, to facilitate transactions, to personalize your experiences and services, and to improve our products and services.
What information do we collect from and about Experience Providers and why?
- When you sign up with Waypointer to conduct an experience via Waypointer, you must provide us with certain information to allow us to identify you and provide services to you. This may include information such as the name of your business (entity name and trade name, as applicable), the physical address or location of your business, your business’ logo or other trademark(s), the name and contact information (email, phone number, and address) of one or more contact people who have the authority to interact with Waypointer for purposes of the Waypointer services, login credentials for your business’ Waypointer account (such as a username and password), billing and payment information to make or receive payments (as applicable), and the name and relevant information about the event(s) that you wish to offer through the Waypointer services (including the structure and rules for any rewards, points, or prizes available as part of your event).
- When you use our services, we may collect information about how you interact with those services, such as information about your device, the web browser or app you are using, your IP address, your time zone or specific device location, some of the cookies that are installed on your device, and the pages or services that you access during your use of our services. We may collect information like this using the following tools:

- We also collect information about the performance of our products, services, and systems. This information helps us to run, improve, and protect our products and services. Information like this entails collecting information about your usage, as well as others’ usage, of Waypointer products and services, and aggregating it so that we can study and use it for our legitimate purposes.

For instance, you may wish to send an offer to Merchants who participated in one of your past events or to End Users who have expressed interest in events, businesses, or products related to an experience you wish to offer. When our service sends targeted marketing communications like this on your behalf, you will not receive the personal data of the Merchants or End Users who receive the messages except to the extent that they respond directly to you and provide their information outside of the Waypointer services.
